1. The BCU Bank Customer Care Grants program (the Program) is operated by Police & Nurses Limited (ABN 69 087 651 876) of Level 6, 556 Wellington Street, Perth WA 6000, trading as BCU Bank (we, us or our).
2. Submitting a nomination or accepting a contribution under the Program constitutes acceptance of these terms and conditions.
Nominating an individual or family
3. A person (Applicant) may nominate an individual or family (Nominee) to participate in the Program by completing the nomination form on the Program webpage/s or as otherwise directed by us.
4. Nominations can be made by our current customers, including staff, who have been customers for at least six months at the time of making the nomination. We may, in our discretion, also invite individuals or families to self-nominate.
5. Customers eligible to make a nomination may make up to four nominations per calendar year (each nomination must be for a different individual or family).
6. Nominees:
a. must be permanent residents of Australia;
b. must be a customer of ours of at least six months at the time of being nominated; and
c. cannot be our staff (or an officer, contractor or agent of ours) or a member of their immediate family.
Where the Nominee is a family, at least one family member included in the nomination must meet the requirements in (a) and (b) above.
7. An Applicant may nominate themselves or the family they are a member of providing that the Nominee eligibility requirements in clause 6 are met.
8. As part of making a nomination, the Applicant will be asked to provide information about the Nominee. The Applicant confirms they have the Nominee’s consent (or are otherwise authorised) to provide that information to us for the purpose of administering the Program.
9. We may contact a Nominee to confirm information provided by an Applicant or to obtain additional information in support of considering the Nominee’s participation in the Program.
Our selection of Nominees
10. We will consider nominations on a case-by-case basis as they are received. We may, in our discretion, decide to provide a contribution to a Nominee under the Program, which may be provided as cash or services.
11. Once a nomination is considered, we will notify the Nominee or Applicant of our decision as to whether or not the Nominee is a Selected Nominee using the contact details provided in the nomination. We will generally provide this notification within two weeks of receiving a correctly completed nomination.
12. Once we have made a decision on a nomination, that nomination is spent and is not eligible for further consideration under this Program.
13. The amount of cash or the value of services to be provided by us to a Selected Nominee as a contribution will be determined by us in our reasonable discretion.
14. A decision not to select a Nominee as a Selected Nominee is not intended to be, and should not be taken as, a reflection on the Nominee’s circumstances or the seriousness of their situation. Our ability to provide contributions under the Program is limited and the number, timing, type and value of contributions we can provide may vary over the life of the Program.
Receipt of contributions
15. To receive a contribution, a Selected Nominee must:
a. provide information as we reasonably required to confirm the Selected Nominee’s identity;
b. if the contribution is cash, specify a BCU Bank account which must be in the name of the Selected Nominee (or where the Selected Nominee is a family, a family member that forms part of the Selected Nominee) in which to receive the contribution;
c. if the contribution is services, accept any terms, meet any conditions, and provide any information or assistance reasonably required by us to make available the services; and
d. show, to our reasonable satisfaction, that they meet the requirements in these terms and conditions.
16. If a Selected Nominee does not meet the requirements in these terms and conditions to receive a contribution within three months of being notified by us of any proposed contribution, the contribution will be cancelled.
17. We may, in our discretion (acting reasonably), cancel or vary any contribution. Reasons may include where information about a Selected Nominee provided in the nomination is materially incorrect, or where the Selected Nominee has engaged in conduct that may, in our reasonable opinion, bring us or the Program into disrepute, scandal or ridicule.
18. Contributions provided to a Selected Nominee:
a. are not transferable;
b. cannot be used for hazardous, dangerous or illegal activities, gambling, or to cause harm to the community or any people or animals; and
c. cannot be used for fundraising or donated to another person or organisation.
Promotions
19. We may request that Selected Nominees (and their Applicant if a Selected Nominee did not self-nominate) participate in promotional activities relating to the contribution, including but not limited to being interviewed and photographed. Consenting to participate is not a requirement of receiving a contribution. By consenting to participate, a Selected Nominee or Applicant grants us a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide, including online social networking sites, and the Selected Nominee and Applicant will not be entitled to any fee for such use.
General
20. Our decision in relation to any selection of Selected Nominees and awarding of contributions is final. No correspondence will be entered into.
21. We are not liable for any loss, injury or damage suffered directly or indirectly by any person in connection with the Program (including any decision to grant or not grant a contribution, and any use of a contribution by a Selected Nominee), except to the extent caused by our fraud, negligence or wilful misconduct (including that of our officers, employees, contractors or agents).
22. All contribution-related expenses, including without limitation any taxes payable by the Selected Nominee on the contribution, shall be the sole responsibility of the Selected Nominee.
23. Our Privacy Policy contains information about how Applicants, Nominees and Selected Nominees may access and seek correction of personal information held by us, make a complaint about a breach of privacy rights, and how we deal with complaints. Our Privacy Policy is available on our website and on request.
24. We reserve the right to:
a. end the Program without notice; and
b. amend these terms and conditions (including in application to prior received nominations) to protect our legitimate business interests, and only to the extent reasonably necessary to do so.
25. These terms are governed by the laws of Western Australia. Parties submits to the non-exclusive jurisdiction of the courts of Western Australia and the Commonwealth of Australia.
